Does the EU AI Act apply to a United States AI company?
The EU AI Act applies to a United States AI company when it places a system or a model on the European Union market, or when a system it built is used in the Union and its output is used there.
The Act is not limited to companies established in the Union: a provider outside the Union that places a system on the Union market carries the provider duties, and a provider of a general-purpose model outside the Union carries the Chapter V duties. An operator can appoint an authorised representative in the Union instead of an establishment. Whether the Act reaches a particular company depends on its facts; the tool names the question and links the articles rather than opining.
